Senior Cole County Judge Byron Kinder ruled yesterday that Attorney General Jay Nixon cannot be barred from suing the Missouri Department of Natural Resources in the dispute involving the Union Pacific Railroad bridge considered a potential part of the Katy Trail. Attorneys for the MDNR had argued that Nixon's office should be disqualified from bringing the lawsuit because of Assistant Attorney General William Bryan's knowledge of MDNR affairs. The MDNR attorneys did win the right to depose Bryan in the matter.
